Hurt Truck Driver Sues NHAI for Bad Roads

  • It’s common for citizens abroad to sue government bodies for non-maintenance of public property and the damage thus suffered. But in India, it’s almost unheard of. In the first case of its sort, truck driver Badri Lal Gurjar lodged a complaint against the National Highways Authority of India (NHAI), for digging a 10-foot-deep pit and leaving a pile of mud around it because of which Gurjar’s truck turned turtle and he sustained injuries. Even reflectors were not installed, the police said.

  • The police have registered a complaint to this effect under sections 283 and 336 of the IPC for endangering the life of others and obstructing and creating danger in public way. The truck driver sustained major injuries on his leg and hand. “We have examined his [Gurjar’s] injuries and the accident site,” the police said. Station house officer Rajendra Singh at the Karni Vihar Police station informed that Gurjar's truck turned turtle on the Express Highway around 8:30 pm on Tuesday night. The mishap occurred because labours had left a pile of mud around a10-foot-deep pit. The labourers hired by NHAI are not skilled and are untrained; this often leads to the accidents, police said.
